Public Hearing – Zoning Amendment – Section 5.1 (Neighborhood Overlay District) 
The public hearing notice was read into the record. 
Co-Chairman Winters explained that this is the final piece which states that the granting of the setbacks, the mixed use, and the multifamily residence are all done by Special Permit.  In addition, Site Plan Review would be required, which could include an Environmental Impact Assessment, traffic study, architectural review, and engineering review.  Requests for Special Permits and site plan review are forwarded to Town Departments and Boards for their comment.  He read the criteria contained in Section 7.2 of the bylaw in the record. 
Elizabeth Brainard, 23 Rogers Drive, voiced concern for the proposed 0’ front yard setback.  Member Magauran explained that a 0’ lot line would not be allowed by right but by Special Permit and also that there would be sidewalks and trees between the street and any proposed dwelling.  Mrs. Brainard was also told that larger setbacks typically resulted in more curb cuts.   
 
Moved by Co-Chairman Winters and seconded by Member Gonsalves to close the public hearing.  VOTE:  7-0-0
